Regarding the Ministry of Labor’s Circular:

The Ministry of Labor has provided the following documents:

  • “Qualification and Review Standards for Foreigners Engaged in Employment as Specified in Article 46, Paragraph 1, Items 8 to 11 of the Employment Service Act”
  • “Regulations on Employer Hiring Foreign Workers and Management Procedures”
  • “Validity of Documents for Employers Applying to Hire Foreign Workers in Category 3, Application Procedures, and Other Documents Regulated by Central Competent Authorities”
  • “Guidelines for Job or Employer Transfers for Foreign Workers Engaged in Employment as Specified in Article 46, Paragraph 1, Items 8 to 11 of the Employment Service Act”

Explanation:

  1. Introduction of New Category for Employment in the Hospitality Industry:

    • The new regulation allows foreign students, overseas Chinese students, and other Chinese descent students with an associate degree or higher from Taiwanese universities to be hired by the hospitality industry (including hotels, inns, and guesthouses) to work in various hospitality services such as room service, cleaning, reservations, reception, or restaurant services.

    The key details are:

    • Job Content: Eligible individuals can be employed in legitimate, registered tourist hotels, inns, or guesthouses to perform services like room cleaning, reservations, reception, and restaurant duties.
    • Application Requirements: Foreign students, overseas Chinese students, and other Chinese descent students with an associate degree or higher must have completed at least 80 hours of related training or internship courses recognized by the Ministry of Transportation’s Tourism Bureau, or training provided by approved industry associations, or internship programs in cooperation with recognized universities.
    • Salary Standards: The average monthly salary should not be below NT$33,000, or the total annual salary should not be below NT$500,000. However, for foreigners newly hired in the hospitality industry, the minimum monthly salary is NT$30,000. If the salary is NT$35,000 or higher, the training course requirement can be waived.
  2. Post-Employment Transfer:

    • After the employment period in the hospitality industry ends and is not extended, foreign students and overseas Chinese students with an associate degree or higher from Taiwanese universities are allowed to transfer to another employer or job.
  3. Extension of Work Permit for Overseas Students:

    • The work permit validity for foreign and overseas Chinese students enrolled in Taiwanese universities has been extended from a maximum of 6 months to 1 year. The related application forms have also been amended.
